1. About JustVybe

JustVybe ("we", "us", "our", "the platform") is a UK-based local community platform operated by JUSTVYBE LTD, registered in England and Wales (Company No. 17281721), whose registered address is 31 Forest Road, Southport, United Kingdom, PR8 6JD.

By creating an account or using JustVybe you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the platform. These Terms form a legally binding agreement between you and JustVybe.

2. Eligibility

• You must be at least 16 years old to use JustVybe. This requirement applies in accordance with the UK Online Safety Act 2023. By registering, you confirm you are 16 or older.
• We are required by law to verify the age of all users. At registration you must provide your date of birth. Existing users who have not yet done so will be prompted to verify their age on next sign-in. If you do not complete age verification, or if your date of birth indicates you are below the minimum age, your account will be suspended.
• You must not provide a false date of birth to circumvent our age verification requirements. Doing so is a material breach of these Terms and may result in immediate account suspension or termination. By submitting your date of birth you warrant that it is accurate and complete. You acknowledge that we rely on this warranty in good faith and that any loss, liability, or regulatory consequence arising from a false declaration is solely your responsibility.
• If you are under 18, you should review these Terms with a parent or guardian.
• JustVybe is primarily designed for UK-based communities. Users outside the UK may access the platform but do so subject to their own local laws.
• By registering you confirm that the information you provide is accurate and that you have the legal capacity to enter into this agreement.
• Corporate or business accounts must be operated by an authorised representative of that business.

3. Your account

• You are responsible for keeping your login credentials secure. Do not share your password. If you use Google sign-in, you are responsible for securing your Google account and must not use another person’s Google account.
• Google sign-in uses Google’s authentication service to verify your identity. JustVybe receives only the identity information described in our Privacy Policy. Google’s own terms and privacy policy also apply to your use of your Google account.
• When you create a new JustVybe account using Google, you must actively agree to these Terms and acknowledge the Privacy Policy before the account is created. Existing JustVybe accounts may use Google sign-in after the Google identity is linked to the account.
• You are responsible for all activity that occurs under your account.
• You may only hold one personal account. Using multiple accounts to circumvent bans or game platform features is prohibited.
• We reserve the right to suspend or terminate accounts that breach these Terms, with or without notice.
• You may delete your account at any time from Settings → Delete account. See Section 12 for what happens to your data on deletion.

4. Acceptable use

You agree not to use JustVybe to:

• Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory under UK, EU, or applicable US law.
• Impersonate any person, business, or organisation.
• Spam, advertise without authorisation, or promote pyramid schemes, multi-level marketing, or get-rich-quick schemes.
• Scrape, crawl, mirror, or otherwise extract data from the platform without our prior written permission.
• Attempt to gain unauthorised access to any part of the platform or its infrastructure (including port scanning, denial-of-service attacks, or injection attacks).
• Distribute malware, spyware, or any other harmful software.
• Violate any applicable law or regulation, including the UK Online Safety Act 2023, UK Computer Misuse Act 1990, and equivalent laws in other jurisdictions.
• Facilitate the sale or distribution of counterfeit, illegal, or regulated goods (drugs, weapons, unlicensed financial products, etc.).

5. Content you post

You retain ownership of the content you post ("User Content"). By posting it, you grant JustVybe a worldwide, royalty-free, non-exclusive, sublicensable licence to store, host, display, reproduce, modify (for formatting purposes only), and distribute your User Content in connection with the platform's operation — including, where applicable, sharing a vibe on social media at your request.

You represent and warrant that:

• You own or have the necessary rights to post your User Content.
• Your User Content does not infringe any third party's intellectual property, privacy, or other rights.
• Your User Content complies with these Terms and all applicable laws.

We do not endorse any User Content and we are not liable for it. We reserve the right to remove any User Content that violates these Terms, Community Guidelines, or applicable law, without notice or liability.

6. Copyright and DMCA

We respect intellectual property rights. If you believe that content on JustVybe infringes your copyright, please send a written notice to hello@justvybe.co.uk including:

• A description of the copyrighted work you claim has been infringed.
• A description of where the allegedly infringing material is located on the platform (URL).
• Your contact details (name, address, telephone, email).
• A statement that you have a good-faith belief that the use is not authorised by the copyright owner.
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.
• Your physical or electronic signature.

We will review and respond to valid notices in accordance with applicable law. Repeat infringers' accounts may be terminated.

7. Business listings and services

• Business listings on JustVybe are provided as a community directory. We do not guarantee the accuracy, completeness, or reliability of any listing, and we are not responsible for the goods or services offered by any listed business.
• If you claim a business listing, you confirm you are an authorised representative of that business. We may ask you to provide evidence of this before or after a claim is approved, and may decline or reverse a claim we're not satisfied with.
• Transactions between users and businesses (property viewings, job applications, service quotes, car enquiries) are conducted directly between those parties. JustVybe is not a party to such transactions and accepts no liability for them.
• We reserve the right to remove, edit, or unverify any listing that we believe is inaccurate, misleading, or in breach of these Terms.
• Some listings — particularly those not yet claimed by the business — may include menu, price, or product information compiled by JustVybe from publicly available sources on the business's behalf. This information has not been checked or confirmed by the business and may be inaccurate or out of date; see Sections 7.3–7.5 below.

7.1 Claimed listings & Store Fronts

A business that claims its listing may upgrade to a Store Front, which allows it to publish products or services and accept payment directly through the platform. The business remains solely responsible for its pricing, descriptions, stock levels, and order fulfilment, and must comply with the Consumer Rights Act 2015 and all other applicable consumer protection law in respect of anything it sells through its Store Front.

7.2 Stripe Connect payments & commissions

Store Front payments are processed through Stripe Connect. In relation to any purchase made through a Store Front:

• The business is the seller. JustVybe is a facilitator only and is not a party to the transaction between the business and its customer.
• To accept payments, a business must complete Stripe Connect onboarding and separately agree to Stripe's own Connected Account Agreement, which governs Stripe's processing of that business's payments.
• JustVybe's commission is deducted at source from each transaction before the balance is paid out directly to the business's Stripe account. Stripe's own processing fees, disclosed to the business by Stripe under its Connected Account Agreement, may apply separately to the same transaction.
• The business is solely responsible for chargebacks, payment disputes, VAT and other taxes, and regulatory compliance in respect of its sales.
• Transaction commissions charged under this clause are separate from, and in addition to, any subscription fees under Section 8.

7.3 Menu, pricing and allergen information

• Prices, descriptions, and menu items shown on a listing — including those compiled by JustVybe for a business that has not yet claimed its listing — are provided for general guidance only and may change without notice. The price shown at the time of browsing is not a binding offer and may differ from the price charged at the time of order or purchase; always confirm current pricing with the business.
• Where shown, a "last updated" date reflects when that item's information was last edited on JustVybe and does not guarantee that the underlying price, recipe, or availability is still current.
• Allergen and ingredient information, where displayed, is provided as a guide only. It may be incomplete, out of date, or entered by JustVybe on a business's behalf without that business's input, and is not a substitute for checking directly with the business. If you have a food allergy, intolerance, or other dietary requirement, you must check directly with the business before ordering or consuming any item — do not rely solely on information shown on JustVybe.
• Responsibility for complying with food information and allergen labelling law — including the Food Information for Consumers Regulation and the Food Information (Amendment) (England) Regulations 2019 ("Natasha's Law") in respect of food it prepacks for direct sale — rests with the food business, not JustVybe.

7.4 Product and menu images

• Images shown alongside a listing or Store Front item — whether uploaded by the business, compiled by JustVybe, or produced using stock photography or AI image generation — are illustrative only. They are a general indication of the type of item, not a guarantee of the actual item you will receive. Actual appearance, packaging, garnish, portion size, colour, and presentation may vary, in the same way that "serving suggestion" imagery on food packaging does not represent the exact product inside.
• This applies regardless of the image's source or how it was produced, and regardless of whether the listing has been claimed by the business.
• Where an image and a written description conflict, or where the precise appearance or contents of an item matters to you (for example, due to an allergy — see Section 7.3), rely on the written description and check directly with the business before ordering.
• Where we know an image is AI-generated or is a generic stock/placeholder photo rather than a genuine photo of the item, we will typically label it directly beneath the image (for example, "*AI-generated image, actual item may vary" or "*Illustrative image, actual item may vary"). The absence of such a label is not a guarantee that an image is a genuine, unaltered photo of the item — the disclaimers in this Section 7.4 apply to all images regardless of whether a label is shown.

7.5 Third-party trademarks and logos

• Business names, logos, and brand marks displayed on JustVybe remain the property of their respective owners. We display them solely to identify the business a listing relates to, including for businesses that have not yet claimed their listing.
• Displaying a business's name or logo on JustVybe does not imply that the business endorses, sponsors, or is affiliated with JustVybe, and no such relationship should be inferred from a listing alone.
• Conversely, an unclaimed listing is a JustVybe directory profile, not an account operated by, or purporting to be, the business itself. Creating or maintaining such a listing is not a representation that the business has authorised, reviewed, or partnered with JustVybe, and JustVybe does not claim to act on the business's behalf beyond compiling publicly available directory information.
• If you are a trademark or copyright owner and want a logo or brand mark removed or corrected, or if you believe a listing misrepresents a business's relationship with JustVybe, email hello@justvybe.co.uk with the listing URL and details of your request — we aim to action it promptly.

7.6 Local radio streams

• Some business listings for local radio stations include a "Listen live" feature. When you press play, your browser connects directly to that station's own existing public stream, hosted on their own infrastructure. JustVybe does not host, cache, record, proxy, or retransmit the broadcast in any way, and no copy of the audio passes through or is stored on our servers.
• We do not transmit, operate, or hold any licence for a radio signal or stream ourselves — we link listeners to a stream that a station runs independently of JustVybe, on the station's own infrastructure. The featured station is solely responsible for its own compliance with all applicable broadcasting and music-licensing obligations (including Ofcom licensing and PRS/PPL music licensing), and for the content it broadcasts. We do not offer a legal opinion on how broadcasting or music-licensing law applies to a stream-linking feature like this, for JustVybe or for the station.
• A station's name, logo, and schedule or track information shown alongside the player identify the station for listeners' benefit, on the same basis as any other business listing (see §7.5) — their inclusion does not by itself imply an operating partnership, endorsement, or licensing arrangement with JustVybe beyond that.
• If you are a station and want your stream link removed, corrected, or amended, email hello@justvybe.co.uk.

7.7 Auctions

• Some users list items for sale by auction, which other users can bid on. The seller is solely responsible for the item's description, condition, and legality, and for dispatching it once the auction ends. The winning bidder is responsible for paying the agreed price and, where applicable, confirming receipt.
• Payment for a won auction is processed through Stripe. JustVybe deducts a success fee from the amount paid out to the seller — the applicable rate is shown on the listing before you list or bid on an item.
• JustVybe facilitates the auction process and payment but is not a party to the sale between buyer and seller, and does not inspect, authenticate, or guarantee any item listed.
• If a problem arises with an auction, use the dispute process on the auction page. We review disputes raised that way but do not guarantee a particular outcome, refund, or timeframe.
• Items prohibited from sale on JustVybe are set out in our Community Guidelines.

7.8 Classifieds

• JustVybe's classifieds section lets users list items for sale and receive offers from other users directly on the listing.
• Agreeing a final price, arranging payment, and handing over the item are done directly between buyer and seller, off-platform, unless the listing says otherwise. JustVybe is not a party to these transactions and does not mediate them.
• A seller may pay to boost a listing's visibility. This pays for increased visibility only, does not guarantee a sale, and is non-refundable except where required by law.
• Items prohibited from sale on JustVybe are set out in our Community Guidelines.

7.9 Ticketing

• Some vibes and events on JustVybe offer paid tickets. The organiser is responsible for the event taking place as described and for any refund owed if it's cancelled or materially changed.
• Ticket payments are processed through Stripe. JustVybe deducts a platform fee from ticket sale proceeds, disclosed before you buy or sell a ticket.
• JustVybe facilitates ticket sales but is not the event organiser and is not a party to your attendance at any event.

7.10 Gift cards & digital downloads

• Some businesses sell gift cards and digital downloads through their Store Front. A gift card is redeemable against future purchases from the issuing business only, on the terms shown at the time of purchase, and is not redeemable for cash except where required by law.
• Digital downloads are provided by the business, not JustVybe, and are subject to that business's own delivery and support terms in addition to your statutory consumer rights.

7.11 Community fundraising & donations

• JustVybe lets users raise funds for community causes and lets donors make one-off or recurring donations to a fundraiser.
• The person or group who starts a fundraiser is responsible for the accuracy of what they tell donors and for how the funds raised are used — see our Community Guidelines for what a genuine, transparent fundraiser must disclose.
• Donation payments, including recurring donations, are processed through Stripe. You can view and cancel a recurring donation at any time from your account.
• JustVybe facilitates the collection of donations but does not vet a fundraiser's claims, is not itself a charity, and does not guarantee that funds will be used as described.

8. Paid plans

Claiming a business listing is free and includes JustVybe's full set of listing tools. We may, from time to time, offer optional paid plans or add-ons on top of a claimed listing — for example priority placement or extra promotional tools. Where we do, the price and what it includes will be shown clearly on your business dashboard before you buy. The following terms apply to any paid plan or add-on you purchase:

• Billing. Where a plan is billed on a recurring basis, it is billed in advance (monthly or annually, as selected) and payment is processed by Stripe. By subscribing you authorise Stripe to charge your payment method on each renewal date.
• Auto-renewal. A recurring plan renews automatically at the end of each billing period unless you cancel before the renewal date.
• Cancellation. You may cancel a recurring plan at any time from your business dashboard. Cancellation takes effect at the end of the current billing period. You will not receive a refund for the unused portion of the current period.
• Refunds. Paid plan and add-on fees are non-refundable except where required by law. If you believe you have been charged in error, contact us at hello@justvybe.co.uk within 14 days of the charge.
• UK Consumer Rights. If you are a consumer (not acting in a business capacity) purchasing digital content or a digital subscription, you have a 14-day cooling-off right under the Consumer Contracts Regulations 2013. You acknowledge that by immediately accessing the paid features you consent to early provision of the service and accept that your right to cancel may be forfeited once the digital content has been fully delivered.
• Price changes. We will give at least 30 days' notice of any price increase to an existing recurring plan. Continued use after the effective date of a price change constitutes acceptance of the new pricing.
• Platform fees. Where JustVybe takes a commission or platform fee on a transaction facilitated through the platform — for example under Sections 7.2, 7.7, 7.9, or 7.11 — this is separate from, and in addition to, any paid plan fees under this Section, and is disclosed at the point of sale.

9. Affiliate programme

JustVybe operates an affiliate programme. If you refer a new paying business to JustVybe using your referral link, you may earn a commission as set out in the Affiliate Programme terms. Affiliate relationships are disclosed to users via cookie notice. We reserve the right to modify or close the affiliate programme at any time with reasonable notice.

10. Intellectual property

All platform software, design, graphics, branding, and underlying technology are the property of JustVybe or its licensors and are protected by UK and international intellectual property law. You are granted a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose. You may not copy, reproduce, reverse-engineer, or distribute any part of the platform without our written permission.

11. Online Safety Act 2023 and age verification

JustVybe complies with applicable obligations under the UK Online Safety Act 2023. We operate a content moderation and reporting system, maintain community guidelines, and take action to protect users — particularly those at risk of harm — from illegal and harmful content. Our Community Guidelines and reporting tools reflect these obligations.

Child safety. JustVybe has a zero-tolerance policy towards child sexual abuse and exploitation (CSAE) in any form. Any content or behaviour that sexually exploits or abuses a minor is strictly prohibited and will result in immediate account termination and referral to law enforcement. Age verification. As an online community platform, JustVybe may be required to implement age assurance and age verification measures in accordance with applicable law and Ofcom guidance. We collect your date of birth for this purpose. Age verification is currently self-declared; we may introduce additional technical verification methods in future in line with Ofcom guidance. Users found to be below the minimum age will have their accounts suspended without notice and will not be able to create a new account.

Privacy controls. You can control who sees your content using the visibility settings on each vibe: Public (anyone), Mutual followers only, My area (users within 10 miles of your home postcode), or Invite only. These controls are intended to help you share content appropriately and protect your privacy.

12. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless JustVybe and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• your breach of these Terms, including but not limited to providing a false or inaccurate date of birth;
• your User Content;
• your use of the platform in violation of applicable law; or
• your infringement of any rights of a third party.

Where we rely in good faith on information you have provided — including your date of birth — and that information proves to be false, any resulting loss, liability, regulatory penalty, or third-party claim shall be your responsibility alone. We will notify you promptly of any such claim and cooperate reasonably in its defence; our failure to provide prompt notice will not relieve your indemnity obligations except to the extent you are materially prejudiced by the delay.

13. Disclaimers and limitation of liability

JustVybe is provided "as is" and "as available" without warranties of any kind, whether express or implied, including (but not limited to) warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the platform will be available at all times, error-free, free from viruses, or that defects will be corrected. We do not verify the accuracy of content posted by users or businesses.

To the fullest extent permitted by applicable law, JustVybe and its directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
• Any loss of data, profits, goodwill, or other intangible losses.
• Any actions or content of third-party businesses, service providers, or users listed on the platform.
• Any harm arising from a user's false declaration of age, including access by a person who provided an inaccurate date of birth to circumvent our age verification.
• The availability, accuracy, content, or privacy practices of third-party platforms whose media is embedded on the platform (including YouTube, Spotify, SoundCloud, Vimeo, Mixcloud, Deezer, Audiomack, Bandcamp, and Rumble). Embedded content is governed by those platforms' own terms of service and privacy policies.
• The availability, quality, content, or licensing compliance of any third-party radio stream linked from a business listing (see §7.6). We do not host, cache, or retransmit these streams — your browser connects directly to the station's own stream.
• Any transaction between users conducted through Auctions, Classifieds, Ticketing, or Community fundraising (see Sections 7.7–7.11) — these take place between users, and JustVybe is not a party to them.

Where our Community Guidelines describe a target timeframe for reviewing reports or appeals, that target is an operational aim and does not form a contractual commitment under these Terms.

Our total aggregate liability to you shall not exceed the greater of (a) the amounts you paid us in the 12 months preceding the event giving rise to the claim or (b) £100.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law (including under the Consumer Rights Act 2015 for consumers).

14. Termination

You may delete your account at any time from Settings → Delete account. On deletion your personal data will be handled in accordance with our Privacy Policy. Active subscriptions are not automatically refunded on account deletion.

We may suspend or terminate your access at any time for breach of these Terms, with or without notice. On termination your licence to use the platform ends immediately. Sections that by their nature survive termination (Sections 5, 6, 10, 12, 13, 15, 16, 17) will continue to apply.

15. Dispute resolution

UK and EU users. We encourage you to contact us at hello@justvybe.co.uk to resolve disputes informally before taking legal action. If informal resolution fails, these Terms are governed by the laws of England and Wales and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that nothing prevents a consumer from relying on mandatory consumer protection laws applicable in their country of residence.

US users. To the extent permitted by applicable law, you and JustVybe agree to resolve any disputes through binding individual arbitration rather than in court, except for matters that may be taken to small-claims court. You waive any right to bring or participate in a class action or representative proceeding. Any arbitration shall be conducted on an individual basis. If this arbitration clause is found unenforceable, the dispute shall be resolved in a court of competent jurisdiction in the United States.

16. California residents

If you are a California resident, California Civil Code § 1789.3 entitles you to the following information: the platform is provided by JustVybe (contact: hello@justvybe.co.uk). To file a complaint regarding the platform or to receive further information, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by post at 1625 North Market Blvd., Sacramento, CA 95834, or by telephone at (800) 952-5210.

For information about your California privacy rights under the CCPA/CPRA, see our Privacy Policy (Section 9).

17. Changes to these Terms

We may update these Terms from time to time. We will notify registered users of material changes via the platform or by email at least 14 days before the changes take effect. Continued use after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree to the changes, you should delete your account before the effective date.
